MEMBERSHIP PERIOD
If signing up for an Annual Membership you agree that you will join Heart Beats Fitness Studio for the minimum 12 month period specified on the application form and no refund will be given if you choose to cancel your membership before the 12 month period is completed. If you are signing up for a debit payments membership there is No Lock in Contract. To cancel a debit payments membership you must give us 30 days written notice of you intention to terminate this agreement.
MEMBERSHIP ENTITLEMENTS
Your membership entitles you to make full use of club fitness facilities in a first come first served basis. It does not cover the cost of specialist services. Personal Trainers and other specialists may operate from club premises. They are not employees or agents of ours, but operate as independent businesses. Where you choose to make use of their services, you must enter into a contract directly with them, and pay them separately. If your membership is part of a package, which includes Personal Training, we arrange that Personal Training on your behalf but the Trainer supplies that service directly to you.
FEES
A Joining fee applies to all new members. You agree to pay any Joining fee or Lump Sum fee on signing the application form, and a payment in advance covering all regular payments which fall due before your Automatic Payment can be activated.
Further regular payments, to be made by automatic payment to us from your designated bank account, beginning on the date specified in the application form. You must sign an automatic payment form before we will accept this contract. You agree to notify us and complete a replacement automatic payment form if you change your bank account.
STUDIO RULES
You agree to comply with all current Studio rules for members. You must not carry out any illegal acts on club premises, and you must comply with our health and safety requirements, including those directed to your own health and safety. If you carry out any activity, which we consider is offensive or a danger to you or any other person, we reserve the right to require you to leave the club immediately. Club rules may change from time to time.
SUSPENDING YOUR MEMBERSHIP
A member may suspend their membership. A membership can be suspended for a minimum term of one week and maximum term of 8 weeks. A member must complete a suspended Membership request form and lodge it to Heart Beats Fitness Studio Staff at least one week prior to the suspension starting.
TERMINATION OF THIS AGREEMENT
By you the Member
For debit payment memberships It is your responsibility to give us 30 days written notice of your intention to terminate. We will be entitled to continue to regularly accept your fees on the agreed basis until we receive your written notice.
By Heart Beats Fitness Studio
At any time we can terminate your membership immediately by giving you notice in writing, if you breach any term of this contract, including; Failing to pay any fee on the due date, Breaching any club rules, Carrying out any illegal, offensive or unsafe activity on club premises.
OVERDUE PAYMENTS
It is your responsibility to keep your account in funds and to pay all your own bank fees, including any fees your bank charges if your account is overdrawn because of an Automatic Payment.
If any of your Automatic Payments fail, we will place your membership on hold until the payment has been made. If no payments are made after 4 weeks your membership will be terminated.
ADMINISTRATION
Appropriate covered footwear, deodorant, and a shirt must be worn and a towel used at all times whilst in the Studio.
Memberships are not refundable or transferable.
Fitness Studio members are responsible for their access card and smart card. Shared Fitness Studio access with a non-member will result in forfeiture of membership effective immediately.
Each member must respect other studio users and behave in an appropriate manner at all times.
Heart Beats Fitness Studio Staff reserve the right to remove members not complying with terms and conditions of the membership.
ACCESS AND SMART CARDS
All members must bring their access card and smart card on each visit to the fitness studio.
All members must swipe their access card through the turnstile on entering the Studio.
Members can obtain a replacement card if an access card is lost or stolen. Replacement cards are available from Heart Beats staff at a cost determined by Heart Beats Fitness Studio.
If an access card is faulty a replacement card will be issued at no cost to the member only upon return of the original faulty card.
RELEASE AND INDEMNITY
I agree that Heart Beats Fitness Studio will not be obliged to give me any refund if I fail to use my membership or if I terminate my contract for any reason.
I agree that I participate in any studio activity at my sole risk and responsibility.
I release, indemnify and hold harmless Heart Beats Fitness Studio, its servants and agents, from and against all and any actions or claims which may be made by me or on my behalf or by other parties for or in respect of or arising out a an injury, loss, damage or death caused to me or my property whether by negligence, breach of contract or in any way whatsoever.
